LORD MAYOR ERIAS LUKWAGO today appeared before the Court of Appeal sitting, at Twed Towers to represent Hon.Zake Francis Butebi MP Mityana Municipality.
The matter in which Hon.Zake Francis seeks to overturn the decision of Parliament for unlawfully removing him as a Commissioner without following due process was due for judgment last year, however a delay was occasioned when the Court of Appeal lost quorum following the elevation of two Justices of the court to the Supreme Court.
The Lord Mayor said the way Parliament made the decision to remove the Hon.Zake Francis was a akin to carrying out of mob Justice on him.
He was not accorded fair hearing which is in violation of his constitutional right, adding that Hon.Zake was literally lynched by Parliament and Courts should thus protect the sanctity of the Constitution less we loose the little that has remained of it.
Judgement is set to be delivered on Notice.
“While I continue receiving treatment out of the country, my lawyers represented me this morning at the Constitutional Court for the re-hearing of a Petition I filed against Parliament last year.After spending more than a year awaiting judgment, we were informed by the Court that another set of Judges would today hear the Petition afresh. This is because some of the original 5 judges got transferred to the Supreme Court in the middle of writing their respective judgments.I pray that with the re-hearing now done, Court won’t take as long to deliver its verdict. ” – ZAAKE FRANCIS BUTEBI
